What is Section 28(22) and (23) of the Water Amendment By-Law?

The Water amendment by-law requires all owners of sectional title units (residential complexes, commercial and industrial) to install private isolation valves and water meters for each individual unit. 

The City of Cape Town has warned that failure to comply with the amended by-laws will result in fines and potentially jail time!

However, where this is not possible due to the plumbing layout of your property, an exemption from these requirements may be granted.

How to Apply for Water By-law Exemption from Private Isolation Valves and Sub-metering!

The first step is to download and complete the Exemption – private isolation valves and sub-metering application form.

With this form you are required to submit the following documents: 

  • A technical report from a registered water utilities or metering company which details the existing plumbing layout and clearly indicates the work required to comply with the amended water by-law;
  • Minutes of the Body Corporate or Home Owners Association meeting which stipulates clear support for the application.

Once you have completed the application form with all necessary documentation (including the aforementioned technical reports and meeting minutes) you will need to submit your application to the City of Cape Town Department of Water and Sanitation.

The Final Steps

The Department of Water and Sanitation will appoint a City Water Inspector to conduct a full inspection of your property. The City inspector will use the technical report provided by your registered and licensed water metering company to assess the strength of your application.

The City Inspector will require access to all service ducts, hot water cylinders, and to a minimum of three units.
It is important, therefore, that representative (Trustees member or Property manager) of the premises is available to meet with the inspector to ensure access to all necessary areas of the property.

Once your application has been reviewed and the inspection has been conducted, The City of Cape Town Department of Water and Sanitation will contact you in writing to advise you of their decision.
