WHAT DO THE NEW WATER BY-LAWS SAY?
The New Water By-laws include the following changes:
- Each unit in a Sectional Title scheme needs to have its own water meter! This includes all secure or ‘gated’ residential estates and apartment buildings.
- New developments must install water conservation and demand management systems
- An alternative water supply system is also required by the Cape Town Water By-Law.
- Landlords, Property Management Services, Body Corporates and Home Owners must install prepaid or postpaid water meters (such as smart water meters).
WHO IS RESPONSIBLE FOR COMPLIANCE?
If you are an owner of a sectional title unit, your unit needs to have its own water meter. The Body Corporate is responsible for ensuring the process for installation of these meters is completed in compliance with the City of Cape Town water laws.
The Trustees of the Body Corporate can seek assistance from their Managing Agent for the best practice with regard to the sourcing, supply and installation of the water meters.
However, if the Trustees and/or Body Corporate do not take action, the Body Corporate will be fined by the City of Cape Town and not the Managing Agent.
You, as an owner of a unit in a sectional title scheme, ultimately pay this fine!
